appealed from finds that plaintif”s receipts with the 850 added, more than extinguish any just claim of plaintitf; defendant is condemned in the $50 with costs of Circuit Court ; but pluintitf is condemned to pay the costs of contestation. Upon hearing of the cuse in revision, as in his special answer, Hart made grievance of having been discharged from the agency suddenly. But there is nothing in this, for he was not a hired servant or agent hired for a tixed term. He was free to take other employment and to carry on his profession. His mandat could be revoked at any time, without right to him to complain. It was also urged that items had been over. looked by the judge & quo, for instance, 868.31. But, taking up all the accounts and crediting plaintitf with all that he is entitled to, even the $68. 3L, and with 7 per cent commission on receipts and $S2.45 for his bill of costs, we tind, nevertheless, that, by the result of the judment « guo, plaintitf has gotten as much as he was or is entitled to. So that judgment is confirmed in its dispositif. The considérants Will be altered to conform to our findings. (3 R. C., 66.)
