the same business in the same premises. The composition deed referred to is lost, and secondary evidence of its contents have been made. This goes to prove that a condition in it was for revival of the original claims, if the composition was uot punctually paid. The court holds that the pretensions of the Molsons Bank, to rank on their original claim, must be sustained, and the award of the assignee reversed, on the ground that the two persons in each bankrupt firm were the same, and that the discharge under the composition deed was not absolute, but conditional, on the terms of the composition being carried out. This not being done, the original claims of creditors revived. Judgment ordering that the Molsons Bank be collocated for $6,362.37. (4 R. L., 225.)
