PROCEDURE.—JOUR NON JURIDIQUE

Per CuriaAmM: Deseve gave notice that, on the 25th of march, he would apply for his discharge. The 25th was a legal holiday, and he-presented his petition on the 26th. The assignee, by order of the creditors, contests it on this ground, and alleges that the insolvent kept no books, did not give up all his estate, &e. I need not go into the other matters, as I consider the first objection fatal. It was argued that it was covered by article 2 of the Code of Civil Procedure, which provides that when the day on which anything is required to be done is a legal holiday, it may be done on the following day, but this does not apply to anything when the time is fixed by the party himself. We have always held that parties must not fix anything for a sunday or a holiday, or it will be null, and the rule is a correct one. Petition dismissed. (4 R. L., 656, et 2 R. C., 485.)

F.-F, GILMAN, for assignee.
