OF SERVITUDES WHICH ARISE FROM THE SITUATION OF PROPERTY

502. He who has a spring on his land may use it and dispose of it as he pleases.

50 3. He whose land borders on a running stream, not forming part of the public domain, may make use of it as it passes, for the utility of his land, but in such manner as not to prevent the exercise of the same right by those to whom it belongs ; saving the provisions contained in chapter 51 of the Consolidated Statutes for Lower Canada, or other spécial enaetments. — He whose land is crossed by such stream may use it within the whole space of its course through the property, but subject to the obligation of allowing it to take its usual course when it leaves

his land. See arts. 7295 and following of the Quebec Revised Statutes 1909 and 8 George V, chap. 68, 69 and 70.
