14. — " The behaviour and conditions of ail her " Majestie's Officers of the said isle shall be duly exa- " mined and certifyed, without respect of any person ^^ conceming the Goyernment at martiall causes, there " appartaining to justice. The examînaçon to be " used, not by any generalitîe, as it were ex oficiOj " but upon particular informations to be delivered " unto them."

Eapport des Commissaires. Item, '^ to the 14th " article, the said Perin and Carteret requiredus not " to doe any thing toudûng the same."

16. — " What summes of money hâve been levyed " by the said Anthony and George, or at their discre- ^^ tion, of the inhabitants within the said isle, for pro- " vision of munition and fumiture for needfuU défense ^' of the same, since the said Anthony was Captain or " Lieutenant there ; and to shew what value the " summe was of, and how it is employed, and what " munitions and fumiture thereof remaineth ? This " allso to be examined upon informaçon given in '^ particular manner, and bonds to be taken abovesaid."

Eapport des Commissaires. Item, " to the ISth. " There was no particular informaçon offered us with '' bonds according to the contents of this article, all- " though we did often times request the parties pkin- '' tives and generally ail the assembly to informe us at '' large touching the same. But the Captain, hearing ^' that a long time after ail thèse matters preferred '^ against him were heard, that none would informe '' us upon this article, desired us for the better open- '^ ing of his and the said Greorge Foulet's sinceritie,

" touching the contents, to receive his informaçon ^' thereupon, which we did in the présence of the *^ Jurats, the Plaintiff and ail the Assembly. Where- ** upon it did plainly appeiur that a préparation being ^' commanded by the Lords of the Councell, for the '^ défense of the Island, it was agreed amongst them " by Act of Common Councell, Anno. '^ said Captain layd ont, and yett wanteth abont eighty " crownes of his money, wherewith they bonght eighty " barrels of powder, whereof, there being twelve pa- ^' rishes, every parish had one and the petty Gaptains ^^ had the rest fer the défense of the Island, wEich " yet remaineth for that use. And towards this, '* allthough there was a generall contribution agreed " upon, yet the Plaintives hâve hitherto pay no penny. " The money received was orderly bestowed to the " publick good and so accounted for, as by the ^ account did appear, and yet rest undebted to the " Captain as before."

Item, ^^to the 16 th. ^ It did appeare unto us by the Ordinance made " by King Henry Vllth., Anno. Regni 10. That the " OflBlce of the Baillif, the Deane, Sheriffe, and the " Queen's Attorûey were reserved to the King. But ^' upon perusall of the Letters Patents made unto the " said Anthony Poulet by her Majesty, touching his " office of being Govemor there, it doth appeare unto " us that the disposition of those Offices lay novr in ^ his gift, as by his Patent remaining of record may " appeare, where-unto we referre ourselves : and " that by twenty yeares past, the Govemors there " hâve, by virtue of theîr Patents, given the same : '* and touching their liberties, we find not any viola- ^' tion made of them, but that the complainants and " their confederates seeke rather, if it be not care- " fuUy prevented and in tîme stayed, to enlarge the " same, to the préjudice of her Majestie's prérogative " there."
