Cause n» 8 de 4896.
Jugement.
Our Sovereign Lady the Queen against a native vessel, name unknown, sailing under no colours, and having no papers, whereof the owner and master are unknown, her tackle, apparel, and furniture; aiso, against one maie and two female slaves, seized as liable to forfeiture by Micbael P. O'Callaghan, Esquire, a Captain in the Royal Navy, in command of Her Majesty's ship « Philomel ». Before W. B. Cracknall, Esquire, Judge of Her Majesty's Consular Court at Zanzibar, on the 16lhdayofJuly,1896.
Appeared personally Lieutenant Edwin V.
Underhill, R. N., of Her Hajcsly's ship « Philomel »y and produeed his sworn déclaration setting out the circumstances under which the one maie and two female slaves and the native vessel, name unknown, sailing under no colours, and having no papers, whereof both the owner and master are unknown, of the description and dimensions specified in the annexed certificate of admeasurement taken by the captors, were seized by him at Fefuni, Pemba Island, on the 5th and 6lh July, 1896, respectively. I, the said Judge, having heard the évidence and examined the witnesses produeed by the captors, and in default of any person appearing for the defence, having found sufficient proof that the said native vessel shortly before her capture had landed cargo of slaves, which the said one maie and two female slaves formed a part of, in contravention of Treaties existing between Great Britain and Zanzibar, do adjudge the said vessel and the said ihree slaves to hâve been lawfully seized, and to be forfeited to our Sovereign Lady the Queen, and do condemn the same accordingly. And I do further déclare that it has been proved to the satisfaction of the Court that the destruction of the vessel on the spot by the captors was inévitable under the circumstances.
In testimony whereof I hâve signed the présent Decree, and hâve caused my seal of office to be affixed thereto this 16th day of July, 1896.
(s.) W. B. Cracknall,
Judge,
Her Britannic Majesty's Consular Court.
(s.) W. B. Cracknall,
Juge au tribunal consulaire de Sa Majesté.
First Case, Dhatv No. 99.
Affidavii.
I, Edwin V. Underhill, Lieutenant, Royal Navy, of Her Majesty's shîp « Philomel », in command of the second cutter of that ship, baving under my orders Sub-Lîeutenanl Asser, in command of the first cutter, do hereby certify that dhow No. 99, one of her crew, and three slaves, were captured by me under the following circumstances : —
On Sunday, the 5th July, I proceeded with Sub- Lieutenant Asser and cight men to a house near Infuni, where I had heard slaves had recently been landed. On arrivai I found one girl slave, and one boy ; the latter had not been landed from dhow No. 99, but asked to be taken aw*ay, and said he knew the dhow No. 99 and crew, who had recently landed slaves.
Having taken charge of thèse two I proceeded to a house close by, and made prisoner a man who had bought two slaves from dhow No. 99, but subsequently released him on thèse two being brought to me— one boy and one girl^ thus making a total of three slaves and one fugitive.
At noon, on the 6lh, I proceeded in the cutter to look for the dhow No. 99, and having sighted her, gave chase, and fired several shots across her bows, but she did not stop, and lost sight of her, darkness coming on. At 9 p. M., however, I found and boarded her.
The crew recognized, and were recognized by the (iigitive slave boy I had taken the previous evening, and also confessed to having recently landed slaves from their dhow. They were also subsequently recognized by the three slaves who had been landed from dhow No. 99.
I detained the crew (three men) and the dhow, and afier five days, no claim having been made to me by the captain or owner^ I surveyed her, and flnding her unseaworthy, ordered to be sunk. Sub-Lieutenant Asser assisted at the survey.
Two of the crew, whom I had landed, having no room in the cutter for them, escaped
Premier cas, dhotv n9 99.
