Who hath, by these presents, sold, assigned, conveyed and made over, with guarantee against all troubles and evictions, unto Mr.

Brie , étc., hereto present and accepting, the usufruct, during his lifetime, of a house situate at... , etc., (description); to have, hold, use, and enjoy, as usufructuary, the said house and premuises by Mr. B..., during his lifetime, from and after the....., and take and collect the rent thereof from and after the same date,

This sale of usufruct is thus made under thefollowingcharges and conditions to which Mr. B..... hereby binds and obliges himself : 19 To cause to be made, before his taking possession of the said house and premises, at common cost with the vendor, a statement of the condition in which the said house and premises will be then found ; 2° To use and enjoy the said honse in a husbandlike manner, without changing its nature or destination ; 3° To maintain the said house and premises in all tenantable repairs during the term of his usufruct ; 4° To allow all greater repairs to be made thereto, whatever time may be required to make them ; 5° To pay, from and after the... , the taxes and contributions of any nature or kind, imposed upon the said property ; 6° To hold the vendor free and exempt from any claims arising from the fact of the total loss of the said house and premises during the term of his usufruct, by accident or main force ; 7° To pay the cost of these presents.
