continued to à day certain,” and therefore, under Rule 45, the pvrothonotary ought not to have called the case, and the calling of the case by the prothonotary, not only without authority, but in direct opposition to the rules of practice, could not, I think, affect the rights of the parties, any more than if their names had been mentioned in the court by a mere stranger, Our attention has been called to an arrêt of the Court of Grenoble, dated the 24th January, 1812, by which it appears to have been decided : ‘“ Que la péremption de l'instance est interrompue par un appel de la cause à l'audience.” Dalloz. Dict. de Jurispr., verbo “ Péremption, n° 144, p. 848. [Same arrêt referred to 18 Vol. Journal des Avoués, p. 501], see also same word, in Dalloz, n° 174.
See also Carré et Chauveau, Vol. 8, p. 425. “ La péremption n’est pas interrompue... par des bulletins de causes envoyées par le greffier aux avoués.” Paris, 25 août 1832, Journal des Avoués, tome 43, p. 508, et 20 février 1836, tome 50, p. 253. See, also, Dalloz, Dic. de Jur., vol. 3, verbo Péremption, n° 154-155. Our attention was also called to an affidavit made by the learned counsel for the plaintiff. In
ao oou | the first part of that affidavit, it is stated “ that the defenupon M.
‘ dant’s enquête was continued from time to time, at the ex- “ press request of the defendunt’s attornies, or some other gent-
à “ leman representing them, and was never continued at the
A «< fi
request of the plaintiff or deponent.” The last continuance of the defendant’s enquête appears, as already mentioned, to
À have been before the commencement of the three years upon “which the defendant relies, and therefore this part of the : affidavit does not seem to me important.
The learned counsel for the plaintiff, in the second part of his affidavit, alleges
“ that, in consenting to continue the defendant’s enquête from “the time the same was tixed until the 31st. day of Oct. 1868 “inclusively. Deponent was present in Court upon each “enquête day, the said cause was called from the Roll, in
order to be present at the examination of any witness the ‘ defendant might produce, and to cross-examine the said wit- ‘ness, and, frequently, upon these occasions, at great person- “al inconvenience to deponent, who was the attorney for “the plaintiff in this cause” According to this affidavit
which is not contradicted in any way, the case seems to be one of great hardship for the plaintitf, and, if, consistently with my duty, I could afford the plaintitf relief, 1 would be glad to do so; but, as à matter of law, the atfidavit shows that the counsel of the plaintiff was present when the case was called, in the month of October, 1868, but that he did not say £ or do any thing whatever on this occasion : and I do not | think that his mere presence when the case was called, tends (in a legal point of view) to improve the position of his client. | The learned counsel for the plaintiff cited also an arrêt of
the Cour Royale de Rouen, of the 5th July, 1828, deciding M
that: * Lorsque la péremption a lieu par le fait et la négli- À
gence des deux parties, les juges peuvent se dispenser de la M
prononcer.” Journal des Avoués, Vol. 38, p. 215. (See also
