SOCIETE.—DEMANDE INCIDENTE

PER CURIAM: Plaintiff, a widow, sues to have radié a mortgage on a vessel, alleging that the debt was paid by her late husband. The firm of Archer, Labelle & Co. consisting of three partners, is sued. Archer alone contests and puts in an incidental demand for moneys alleged to be due the firm by pluintiff. A demurrer is pleaded to this on the ground that Archer alone cannot claim money said to be due the firm. The demurrer is well founded, and must be maintained, and the incidental demand dismissed. (4 R. L, 461).

DUHAMEL & RAINVILLE, for plaintiff.

PERKINS & MonK, for Archer.
